Powers of Attorney


Powers of attorney may be granted by Spanish or foreign citizens in order to authorize a representative or agent to carry out any legal act or business activity valid in Spain on their behalf​.

Spanish Consuls may perform notarial functions, like ​notaries in Spain, ​but may refrain from doing so ​when it is considered to ​​contravene local or Spanish legislation or when there is a lack of verification of the veracity of the information declared by the interested party, especially those of fiscal significance.

​​Please be advised that an appointment will only be granted if a copy of ALL required documents is properly received. Please do not request an appointment without presenting all required documents. 


REQUIRED DOCUMENTS

  • Power of Attorney Request Form: The Request Form must be duly filled out by the grantor(s) of the Power of Attorney, including the selection of the Type of Power of Attorney that you wish to sign;

Please ensure you include ALL complementary documents as indicated on the Request Form, depending on the type of Power of Attorney selected

  • ​Copy of valid, unexpired Passport, DNI and/or NIE of grantor(s) and representative(s);
  • ​Draft provided by a Spanish Notary or lawyer, if applicable​.​

​PROCEDURE

​All provided documentation will be reviewed by the Notary Department. This Consular Office reserves the right to request any additional documentation as deemed necessary. 

A personal appearance at the Consular Section in Washington, D.C. is always required on the day of the assigned appointment, when the Power of Attorney will be signed. Grantor(s) must identify themselves with the original, unexpired Passport, DNI and/or NIE. 

Cost: Approx. $60, to be paid ONL​Y in cash or by money order on the day of your appointment. 

The grantor will receive a copy of the Power of Attorney at the end of the appointment, which must be physically sent (by hand-off or postal mail) to the representative or agent in Spain. 

More information on the procedure will be provided by email once an appointment has been set.

REQUESTING AN AUTHORIZED COPY OF A POWER OF ATTORNEY SIGNED AT THIS CONSULAR OFFICE

​A party with a legitimate interest in a Power of Attorney (i.e., grantor, representative/agent, or a legal representative acting on behalf of one of these) may request an Authorized copy by submitting the Authorized copy Request Form to the Notary Department's email address: emb.washington.not@maec.es
